All contributions to "2020 Climate Unity Fund” (the “Fund”) are earmarked contributions within the meaning of 11 C.F.R. §110.6(b) to Democracy Engine Inc. PAC and will be forwarded to the Presumptive Democratic Nominee for President of the United States for the 2020 elections. We define the "Presumptive Democratic Nominee" as the candidate who no later than 11:59 P.M. Eastern Daylight Time ("EDT") on the day prior to the scheduled start of the 2020 Democratic National Convention ("Convention"), has received enough pledged delegates to secure the Democratic nomination for president on the first ballot at the Convention (the pledged delegates must be registered with and certified by the Secretary of the Democratic National Committee).

Democracy Engine Inc. PAC will forward all earmarked contributions to the principal campaign committee of the Presumptive Democratic Nominee promptly after the nominee is identified, but not more than ten days later. Unless otherwise designated by the contributor, the first $2,800 of any contribution from an individual or $5,000 from a PAC to the Fund will be designated for the primary account of the Presumptive Democratic Nominee; any contribution to the Fund above $2,800 from an individual or $5,000 from a PAC will be designated for the general election account of the Presumptive Democratic Nominee.

In the event that there is no Presumptive Democratic Nominee, your contribution will be forwarded to the Democratic Nominee for President as selected by the delegates to the Democratic National Convention (the “Democratic Nominee”). Democracy Engine Inc. PAC will forward all earmarked contributions to the principal campaign committee of the Democratic Nominee promptly after the nominee is selected, but not more than ten days later.

If the nominee declines to accept the contributions in the Fund, your contribution will be divided evenly and transferred in equal parts to NextGen Climate Action Committee and LCV Victory Fund, each a political committee that is registered with the Federal Election Commission.

Please note that in the event any individual makes a contribution to this Fund or any contribution to an account of a presidential campaign committee established by the Presumptive Democratic Nominee or the Democratic Nominee that, when added together, exceed the per-election limits set by 11 C.F.R. §110.1(b)(1) (currently $2,800 per election for an individual and $5,000 for a PAC), the excessive portion must be redesignated and/or refunded to the contributor.
All contributions to candidates for federal office are earmarked contributions within the meaning of 11 C.F.R. §110.6(b) to Democracy Engine Inc. PAC, which will forward the contribution to the campaign committee(s) of the designated candidate(s) within 10 days of receipt.

In the unlikely event that an endorsed candidate were to decline to accept these funds, that part of your contribution will be redesignated as a contribution to the Democracy Engine LLC.

Please note that should you make another contribution to an account of candidate who receives a portion of your Earmarked Contribution, that, when added to this contribution causes the aggregate amount of the contributions earmarked for a candidate to exceed the limit set by 11 C.F.R. §110.1(b)(1) (current limits can be found at https://www.fec.gov/help-candidates-and-committees/candidate-taking-receipts/contribution-limits/), an excessive contribution will have been made.
